PENALTIES FOR DUI Under Kentucky law anyone operating a motor vehicle with a blood alcohol level of .05 ml is presumed to be guilty of operating a motor vehicle under the influence. Penalties for DUIs are as follows: 1st Offense- Two to thirty days in the County Jail or a fine of not less than $200.00 to $500.00 plus loss of license. Attending ADE school is also required. 2nd Offense DUI minimum of 7 days in jail to a maximum of 6 months, loss of license for one year, ADE school 3rd Offense DUI - minimum 30 days in county jail to maximum 1 year, loss of license for no less than 2 years, court costs and fines. In some cases 3rd offense DUI depending on the blood alcohol level can also equate to a felony. 4th offense DUI - is a class D felony; penalty range from 1-5 years plus loss of license for up to 5 years. In addition, refusal to take any requested tests, such as blood, breathalyzer or urine sample is an automatic loss of license for six months.
